AlphaGallery — Terms of Use

Effective 28 August 2026. AlphaGallery is published by Alphazulu LLC ("we", "us"). Questions, requests and complaints: [email protected].

These terms are the agreement between you and Alphazulu LLC for the AlphaGallery app and, if you turn it on, the Cloud Backup service. They are written to be checked against the app rather than to reassure you. Where something is uncomfortable it is stated plainly — see If your subscription ends, Your recovery code and Limits of liability.

The Privacy Policy describes what we do with your data and forms part of these terms.


The short version


Who may use it

You must be at least 13 years old, and old enough in your country to agree to a contract on your own. If you are under the age of digital consent where you live, a parent or guardian must agree to these terms for you.

You may not use the service if we have previously terminated your account, or if sanctions or export laws prohibit it.

The app itself

The app is licensed to you, not sold. You may install and use it on devices you own or control, for personal, non-commercial use, under the rules of the store you obtained it from.

You may not sell, rent or sub-license the app, remove its notices, or reverse engineer it except to the extent that law expressly permits despite this term.

The app changes. Features may be added, altered or removed. Where a change would remove something you are paying for, see If we change a plan.

Subscriptions

Pro and the storage plans are sold as auto-renewing subscriptions through the App Store or Google Play. The prices in the app at the time of purchase are the prices that apply; the ones below are the launch prices in US dollars and may differ in your currency and with local tax.

Every step includes all of Pro. There is one ladder and no one-off purchase.

How renewal works. Payment is charged to your Apple or Google account at confirmation of purchase. The subscription renews automatically for the same period at the same price unless you turn off auto-renew at least 24 hours before the current period ends. Your account is charged for renewal within 24 hours before the period ends.

How to cancel. Manage and cancel your subscription in your store account — on iPhone under Settings › your name › Subscriptions, on Android in Google Play › Payments and subscriptions. The app links to both. Deleting the app does not cancel a subscription. We cannot cancel it for you, because we never take the payment.

Refunds are handled by Apple and Google under their own policies, not by us.

Free storage. Cloud Backup requires a subscription; the 10 GB is what Pro includes rather than a free tier.

Codes. A code issued by us grants access without payment for a period we set. It is not a discount on a store subscription and has no cash value. A real discount can only come from Apple or Google.

If your subscription ends

When a subscription lapses or is cancelled, your backup enters a 30-day read-only period. During it you can browse, download and restore everything, and nothing new can be uploaded. Your storage limit reverts to what your current plan allows.

After 30 days, files above your remaining allowance are permanently deleted. This is irreversible. Take a copy out before the window closes — every folder can be downloaded from cloud.alphagallery.app, and the app can restore to your phone.

Nothing on your phone is affected by a lapsed subscription. The app keeps working, and the Recycle Bin, the deletion log and restore remain free.

Cloud Backup

Cloud Backup is off by default and does nothing until you turn it on. When it is on, copies of the photographs and videos you choose are stored on our servers.

What you may store. You must have the right to store and, if you share it, distribute what you upload. You may not use the service for content that is unlawful where you or we are — in particular, material that sexually exploits children, which we report to the appropriate authorities and which will end your account without notice. You may not use it to distribute malware, to infringe copyright, or to work around your storage limit.

We do not screen your files, and no automated system inspects their content. That means these rules are enforced when something is reported to us, not before.

Ownership. Your files remain yours. You grant us only the permission we need to run the service: to store, copy, transmit and display your files back to you, to the people you share a link with, and to your other devices. Nothing here lets us use your photographs for any other purpose, and we do not use them to train machine-learning models.

Encryption. Files are encrypted in transit and at rest on our storage. It is not end-to-end encrypted: we hold the keys and can technically open your files, and a valid legal order can compel us to disclose them. This is stated in the app and in the Privacy Policy, and we would rather say it than let you assume otherwise.

Availability. We aim to keep the service running and make no guarantee that it will be. Cloud Backup is a convenience, not an archive of record. Keep another copy of anything you cannot lose.

Fair use. Storage plans are for your own photographs and videos. We may suspend an account that is using the service as general file hosting, as a content-distribution network, or in a way that degrades it for others.

Your recovery code

If you back up without signing in with Google or Apple, your account exists only on that phone and its recovery code is the only way to reach it from another one. We store a hash of it and cannot read it back.

If you lose that code, the backup is unrecoverable. Not by support, not by proof of purchase, not by us. Sign in if you would rather not carry that risk.

We will never ask for your recovery code by email, and the website has no field that accepts one. A page asking for your recovery code is not ours.

Hidden

The Hidden folder is protected by a PIN you set. We store only a hash of it.

If Hidden is backed up and you have signed in, you can reset a forgotten PIN. If you have not signed in, a forgotten PIN cannot be reset by anyone, and the app says so before you choose that route.

Hidden is not encrypted separately from the rest of your backup, and the Encryption paragraph above applies to it in full.

Shared links

A shared link serves files from your backup. Every link requires a password and an expiry date, and you can revoke one at any time.

A downloaded file is the original, and an original can contain the location and time it was taken. The share page does not display that information, but switching downloads on means the person you shared with can read it. You choose who receives a link, and you are responsible for what you share.

Deleting things

Nothing the app deletes goes straight to permanent deletion. Items you clean go to the app's Recycle Bin, and only when you empty it does the operating system take them — to your phone's own trash for 30 days on iPhone, and on Android 11 and later. On Android 10 and earlier the operating system provides no trash and the deletion is permanent; the app says so on those devices.

You can delete your account and everything in it from inside the app and from the website. That deletion is real: the files, the account and the email address are removed. An audit ledger of operator actions is kept, and it records what was done without identifying who it was done to.

Suspension and termination

You may stop using the service at any time by deleting your account.

We may suspend or end an account that breaks these terms, that we are legally required to act on, or that is being used to harm the service or other people. Where the law and the circumstances allow, we will tell you first and give you a chance to take your files out. If we end your account for something other than a serious breach, we will give you at least 30 days to download what is stored.

If we discontinue Cloud Backup entirely we will give at least 60 days' notice and a way to download everything.

If we change a plan

We may change prices or what a plan includes. A change to a subscription you already hold takes effect at the next renewal, not during a period you have paid for, and Apple or Google will ask you to confirm a price increase before it is charged. If you do not accept it, the subscription ends at the end of the current period.

Changes to these terms

We may update these terms. The effective date at the top changes, and material changes will be notified in the app or by email before they take effect. Continuing to use the service after that means you accept them.

No warranty

The app and the service are provided "as is". To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that it will detect every duplicate, every blurred photograph, or every event correctly.

Some places do not allow these exclusions, in which case they do not apply to you and you keep whatever rights your local law gives you. Nothing here limits consumer rights that cannot be limited by agreement.

Limits of liability

To the fullest extent the law allows, Alphazulu LLC is not liable for indirect, incidental, special or consequential damages, nor for lost profits, lost data or lost photographs.

Our total liability for any claim is limited to what you paid us in the twelve months before it arose — which, if you have never subscribed, is nothing.

This is the ordinary limit for a service at this price, and it is the reason Availability says to keep another copy of anything you cannot lose.

Nothing in these terms excludes liability for fraud, for death or personal injury caused by negligence, or for anything else that cannot lawfully be excluded.

Apple and Google

These terms are between you and Alphazulu LLC, not with Apple or Google.

Where you obtained the app from the App Store: Apple has no obligation to provide support or maintenance for it; Apple is not responsible for any claim that the app fails to conform or infringes anyone's rights; and any such claim is ours to handle. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

You must comply with the applicable store's own terms of service.

Law and disputes

These terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules, and the courts there have exclusive jurisdiction — except that if you are a consumer, you may bring proceedings in the courts of the country you live in, and you keep the protection of that country's mandatory consumer law.

Please write to [email protected] before starting a formal dispute. Most things are quicker to fix than to argue about.

The whole agreement

These terms and the Privacy Policy are the entire agreement between us about the service. If a court finds part of them unenforceable, the rest continues to apply. Our not enforcing a term is not a waiver of it. You may not transfer your rights under these terms; we may transfer ours to a successor of the business, with notice.
